Sexual Abuse, Neglect, Bullying of a Special Needs Child in New Jersey By Santo Artusa on September 24, 2020

In New Jersey schools, problems such as: Sexual Abuse, Bulying and Neglect occur almost everyday. These are just three major problems schools face when neglecting their duties with special needs children in the New Jersey Public and Private school system that is already taxed with budget cuts and the like. Schools have a duty of care for the children that they educate. While it can be difficult to keep an eye on every student at all times, the school can be liable for all activity on the school site and even off site and transportation. Special needs children are often neglected, bullied and abused at a much higher rate than students who do not have special needs. Regardless of the reason, it is unacceptable for any student's bullying, anuse or neglect to be ignored or simply tolerated. If it were my child, it would not tolerated, period. Someone or many would be held accountable for the pain caused onto an innocent child in a New Jersey school. From the time a child is waiting for a bus, on the bus, at school and on way back home, the school and its affiliates are responsible for the care of your child and must be vigilant in protecting students from bullying, from sexual and verbal abuse from students, teachers, etc and vigilant in not neglecting students' needs. Regardless if the abuse or negligence is as blatant as bullying and physical attacks/abuse at school or on the bus, etc or if the school has failed or is failing your child by not following an IEP, if complaints have been filed with the Office of Special Education in Trenton (specialeducationcomplaints@doe.gov) , if you need or have done a special education due process hearing with the Office of Administrative Law (NJ OAL), if complaints have been ignored, and other important measures that have been ignored, we can help you.

While you may not want or did not want financial compensation for neglect or other acts against your child, as you only wanted the best for your child every day, now that the school has failed, your child should be compensated for what he or she has been through and measures must be taken to prevent future problems for your child and frankly, any child. Our New Jersey legal team is ready to fight for those who have been hurt due to negligence of schools and school district contractors. That hurt or that injury may not be physical, or maybe it is, or maybe its both physical and emotional pain. It may take a long period of time to heal. Some may never fully heal.

It is unfortunate that people can be cruel, extremely cruel. Making fun of those that are disabled, those that are not like you, those that can frustrate you. It happens veryday with students, teachers and even higher up in the educational chain. How would you feel if you were bullied everyday to the point that you went home and cried everynight? You tried to seek help or did not want to out of fear but everybody knew and looked the otherway? Or if you did, it got worse and nobody did anything? Schools can be held responsible if they do not meet their duty of care that is required of them. As New Jersey personal injury bullying and abuse lawyers, we are skilled in handling these matters and have the passion to fight for those who are often overlooked. Don't  let this happen to you or someone you care for!
