DIVORCE IN NEW JERSEY WHAT TO EXPECT

Seeking a fast divorce in New Jersey or elsewhere may not be the smartest move every time. While we all want to obtain a divorce quickly whether it is in New Jersey family court or in other states, the smarter way to go is to make sure that all of your bases are indeed covered so that you do not waive something you may be entitled to or sign something you should not have signed.

Divorce and family court Judges in New Jersey make decisions based on the evidence presented to him or her or by including any agreement in writing that the parties seek to include in the final divorce judgment. That being said, a divorce takes time.

Parties cannot simply show up to court and make demands and a judge makes a quick decision. The only sure thing that is conducted is a quickly decided divorce that would never happen under the rules of civil procedure that family court judges must follow. 

In my years of experience in New Jersey divorce court, there are issues that may seem simple that would not cause a divorce from slowing down but in fact become complex and can halt the case in its tracks. One major cause of delaying a divorce is child custody and the issues related to child custody, parenting time and so forth.

New Jersey family court does offer mediation for parenting time and child custody issues and it is very helpful but if both parties do not agree, there is no deal and the case continues. Nobody can force someone to agree. However, if you do not have children together or there is an agreement in place about the children in the past or a past court order, you may not have to worry about this issue. If there is a new agreement between you and your spouse, we can place that in writing for a Judge to include in your final divorce judgment.
