In 2013, New Jersey made a momentous decision to legalize same-sex marriage. As a result, same-sex couples were granted the same marital rights as heterosexual couples. This includes divorce and separation rights. Just as same-sex marriage is covered by the law, so is same-sex divorce, and the process is largely the same as heterosexual divorce.
Recall that the basic requirements for filing for divorce in New Jersey are the residency requirement and the grounds for divorce. More specifically, either spouse must have been a New Jersey resident for the last 12 consecutive months, and the spouses must cite either no-fault divorce (irreconcilable differences) or fault-based divorce.
Important Considerations in Same-Sex Divorce
The divorce settlement will address a number of issues relevant to the divorce, such as property division and spousal support. Note that when determining equitable distribution and alimony, a judge will often look at the length of the marriage. (The longer the marriage, the more marital property or alimony a spouse may be entitled to). However, because same-sex was legalized in 2013, there is a concrete cap on the start of the marriage, whether or not the individuals were a couple even before then. The outcome depends on the situation, though, and it may be possible for a judge to consider the length of the relationship rather than the marriage if they so choose.
